Government & Law-Enforcement Data Request Guidelines

These guidelines describe how EVE NeuroSystems LLC ("EVE") responds to requests from government and law-enforcement agencies for customer or user data. We are committed to protecting our customers' and users' data and to responding to lawful requests in a principled, transparent way.
Valid legal process is required
EVE discloses data only where required by valid, binding legal process appropriate to the data sought (for example, a subpoena, court order, or warrant), or in a genuine emergency involving a risk of death or serious physical harm. We review each request for legal sufficiency and will object to, narrow, or challenge requests that are overbroad, defective, or legally deficient.
Where EVE holds data as a processor
For most customer data, EVE acts as a processor / service provider on behalf of a customer that is the data controller. We will generally not produce a customer's data in response to a request directed to EVE; instead, where lawful, we will direct the requesting agency to seek the data from the customer, and we will notify the affected customer so that it can respond.
Notice to customers and users
Our policy is to notify the affected customer (or user) of a request for their data before disclosure, so they may seek to limit or challenge it, unless we are legally prohibited from doing so (for example, by a valid non-disclosure order) or an emergency requires otherwise. Where a prohibition later expires, we will provide notice.
How to submit a request
Agencies may submit legal process to [email protected] (subject line: "Legal Process"), or by mail to EVE NeuroSystems LLC, 3480 Preston Ridge Road, 5th Floor, Suite 5109, Alpharetta, GA 30005, United States. Requests should identify the requesting agency and officer, the legal authority relied on, and the specific data sought. Accepting delivery by email is not a waiver of any legal objection or of any requirement for proper service.
